FASTag mandatory from 1.1.21

Union Minister for Road Transport, Highways and MSMEs Shri Nitin Gadkari today announced that FASTag is being made mandatory for all vehicles in the country from new year. Addressing a virtual function today, he said, FASTag will be enforced from 1st of January, 2021. Enumerating its benefits, he said, it is useful for the commuters as they will not need to stop at toll plazas for cash payments. It also saves time and fuel. 

The FASTags were launched in the year 2016, and four banks together issued nearly a lakh of them. By 2017, their numbers went up to seven lakh. Over 34 lakh FASTags were issued in 2018.

Union Ministry of Road Transport and Highways had issued a notification in November this year making FASTag mandatory by 1st of January 2021 in old vehicles also sold before 1st December, 2017 through amendments in CMVR, 1989.

As per Central Motor Vehicles Rules, 1989, since 1st December 2017, the FASTag had been made mandatory for all registration of new four wheeled Vehicles and is being supplied by the Vehicle Manuracturer or their dealers. It had further been mandated that the renewal of fitness certificate will be done only after the fitment of FASTag for the Transport Vehicles. For National Permit Vehicles, the fitment of FASTag was mandated since 1st October 2019.

It has also been mandated that a valid FASTag is mandatory while getting a new 3rd Party Insurance through an amendment in FORM 51 (certificate of Insurance), wherein the details of FASTag ID shall be captured. This shall be applicable w.e.f. 1 April 2021.

This would be a major step for ensuring that the payment of fees be 100% at Toll Plazas through the Electronic Means only and that the vehicles pass seamlessly through the Fee Plazas. There would be no waiting time at the Plazas and would save fuel.

The steps for ensuring the availablity of FASTag at multiple channels are being made through physical locations and also through online mechanism so that the citizens are able to have them affixed at their vehicles within the next two months at their convenience.

Ministry of Road Transport and Highways has made the use of FASTag mandatory for availing return journey discount or any other exemptions on Toll Fee Plazas. Users who wish to claim a discount for making return journey within 24 hours or any other local exemptions, shall be required to have a valid functional FASTag on the vehicle. A Gazette notification no. 534 E dated 24th August, 2020 to amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008  has been notified in this respect.

This is another step towards promoting the use of digital payments on Fee Plazas of NHs. The fee payable towards such discounts shall be paid through pre-paid instruments, smart card or through FASTag or on board unit (transponder) or any other such device only.

The amendments to the Rules would enable-  

i.  For discount on return journey within 24 hours, it would be through FASTag or such other device and automatic and no requirement for a pass.

ii.  For discounts on all other cases, having a valid FASTag is made necessary.

The amendment would also enable that in cases where there is a discount available for a return journey within 24 hours, there is no need for a prior receipt or intimation and the citizen would get the discount automatically if return journey is made within 24 hours with a valid and a functional FASTag on the vehicle.

FASTag to be available free of charge for 15 days

In order to further increase digital collection of user fee via FASTag at NH fee plazas, National Highways Authority of India (NHAI) has decided to waive off the FASTag cost of Rs.100/- for NHAI FASTag between 15th and 29th February, 2020. Road users can visit any authorised physical point-of-sale locations with a valid Registration Certificate (RC) of the vehicle and get a NHAI FASTag free of cost.  NHAI FASTag may be purchased from all NH fee plazas, RTOs, Common Service Centres, transport hubs, petrol pumps, etc. To search for the nearest NHAI FASTag point-of-sale locations, one may download MyFASTag App, or visit http://www.ihmcl.com or Call 1033 NH Helpline number.

The applicable security deposit and minimum balance amount for FASTag wallet shall, however, remain unchanged.

NHAI had earlier announced for Free NHAI FASTag from 22 Nov to 15 December 2019 to encourage people to adopt FASTag.

RBI circular dated 30th December 2019 follows

India is progressing ahead with NETC gaining large scale acceptance. Currently, the NETC system allows linking of FASTags with bank accounts – savings, current and prepaid.

2. In order to further broad base this system by allowing more payment choices for the customers, as well as for fostering competition among the system participants, all authorised payment systems and instruments [non-bank PPIs, cards and Unified Payments Interface (UPI)] shall from now be permitted for linking with the FASTags, which can be used for various types of payments (vehicle toll, parking fee, etc.).

3. The Turn Around Time (TAT) for resolving failed transactions advised vide circular DPSS.CO.PD No.629/02.01.014/2019-20 dated September 20, 2019 shall also be applicable to the transactions carried out in the NETC system.

4. The transactions in the NETC system can be performed without any Additional Factor of Authentication (AFA) and / or pre-transaction notification / alert.

5. NPCI shall facilitate requests received from banks / non-banks in this regard.

6. This directive is issued under Section 10 (2) read with Section 18 of the Payment and Settlement Systems Act, 2007 (Act 51 of 2007).

Amendments Proposed to Central Motor Vehicles Rules

Ministry of Road Transport and Highways has notified draft amendments to the Central Motor Vehicles Rules, making FASTags and Vehicle Tracking System device mandatory for all commercial vehicles obtaining national permit. The front wind screen of the vehicle will have to be affixed with a sticker confirming fitting of the Fastag.  The draft amendments also stipulate other additional conditions for obtaining national permit that include display of the words “National Permit or N/P” in the front and rear of the vehicles in bold letters. In case of trailers, the words “N/P” will have to be inscribed on the rear and left side of the vehicle. The body of a tanker carrying dangerous or hazardous goods has to be painted in white colour and display the prescribed class label on both the sides and rear of the tanker. The vehicle will be affixed with reflective tapes at front and rear.

The proposed amendment also provides that no fitness certification shall be required at the time of registration for new transport vehicles sold as fully built vehicles. Such vehicles will be deemed to be having certificate of fitness for a period of two years from the date of registration. It has also been proposed that fitness certificate of transport vehicles will be renewed for a period of two years for vehicles up to eight years old and for one year for vehicles older than eight years.

The proposed amendment also provides that Driving License and Pollution Under Control certificates can be carried in physical or digital form.

All goods carriage vehicles will be required to carry goods in a closed body of the vehicle or container. If it is necessary to carry goods in open bodies, goods will be covered by using appropriate cover like tarpaulin or any other suitable material. However, goods of indivisible nature, not capable of being carried in a closed body or being covered, may be carried without cover.
