MCA extends due date

Annual forms filing dates have been extended by MCA today.
As per MCA portal – due dates for these forms are further extended
AOC-4/ AOC-4 XBRL/ AOC-4 CFS : 15th March 2022
MGT-7/ MGT-7A : 31st March 2022

Companies get a breather for another month to file the forms, which it was get stifling due to too much of deadlines and compliances. There is a last date for Tax Audit Report, which is falling due on 15th February, 2022 and many company cases, where the accounts and audit reports are yet to reach us company secretaries.

MCA relaxation

MCA has vide its circular no. 17/2021 dated 29th October, 2021 relaxed the additional filing fees in respect of annual filing forms i.e. AOC-4, AOC-4 XBRL, AOC-4 CFS, MGT-7 & MGT-7A for financial year ended 31st March, 2021. Forms will not attract additional filing fees upto 31st December, 2021.

But it was already given this situation because the MCA had earlier on, extended the last date for holding AGM for companies with year ending as 31st March, 2021 from 30th September to 30th November. So under the rules, companies had one month time to file the AOC forms and two months for the MGT forms.

New MCA E-forms

MCA has released the much awaited new e-forms for filing the annual audited accounts and the annual return. These forms i.e. AOC-4 replaces forms 23ac & 23aca and MGT-7 replaces form 20B which was the annual return form under the old Companies Act, 1956. MCA has also given relaxation in additional fees penalty for companies upto 31/10/2015, vide its circular no. 10/2015 dated 13th July, 2015. The new e-forms are available on the MCA site.

Further in case of companies with paid up share capital of Rs.10 crores or more OR turnover of Rs.50 crores or more, the form MGT-7 should be accompanied with a certificate from the Practising Company Secretary in form MGT-8.
